Welcome to Khatu Cab Service! These comprehensive Terms and Conditions (“Terms,” “Agreement”) govern your access to and use of the Khatu Cab Service mobile application, website, and any related services provided by Khatu Cab Service (collectively, the “Service”).
By registering for an account, accessing, Browse, or otherwise using the Service, you signify that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Service.
Please read these Terms carefully before using the Service. They contain important information about your legal rights and obligations.
—1. Definitions
- “Khatu Cab Service,” “we,” “us,” or “our” refers to the company providing the intermediary platform services, headquartered in Bikaner, Rajasthan, India.
- “User,” “you,” or “your” refers to any individual or entity who registers for an account or uses the Service.
- “Driver” refers to an independent third-party transportation provider who utilizes the Service to offer and perform transportation services. Drivers are not employees or agents of Khatu Cab Service.
- “Vehicle” refers to the automobile operated by the Driver for the purpose of providing transportation services.
- “Booking” refers to a request for transportation services placed by a User through the Service, which may be accepted by a Driver.
- “Service Fees” refers to the charges for the transportation service, including the fare, applicable taxes, tolls, surge pricing, waiting charges, cancellation fees, and any other charges specified by the Service.
- “Content” refers to any text, images, videos, audio, or other materials generated, provided, or otherwise made available through the Service.
2. Service Overview and Role of Khatu Cab Service
Khatu Cab Service operates as a technology platform that facilitates connections between Users seeking transportation services and independent third-party Drivers. We provide the digital tools for booking, communication, and payment processing. Khatu Cab Service does not directly provide transportation services; we are not a transportation carrier. The transportation services are provided by independent Drivers who operate their own vehicles. We are not responsible for the acts, omissions, or negligence of any Driver, nor are we responsible for the condition or safety of any Vehicle operated by a Driver.
—3. Account Registration and Security
3.1. Eligibility
To use most features of the Service, you must register for an account. You must be at least 18 years old or the age of legal majority in your jurisdiction (whichever is greater) to register and use the Service. By registering, you represent and warrant that you meet this age requirement.
3.2. Account Information
You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete. Your failure to do so may result in the suspension or termination of your account.
3.3. Account Security
You are solely responsible for maintaining the confidentiality of your account password and for all activities that occur under your account. You agree to notify Khatu Cab Service immediately of any unauthorized use of your account. We are not liable for any loss or damage arising from your failure to comply with these security obligations.
3.4. Non-Transferability
Your account is personal to you and may not be transferred or sold to another party.
—4. Booking and Cancellation
4.1. Requesting a Ride
Users can request a ride through the Khatu Cab Service application or website by providing pickup and drop-off locations, date, time, and other relevant details. The Service will then attempt to match your request with available Drivers.
4.2. Booking Confirmation
A booking is only confirmed when you receive explicit confirmation from Khatu Cab Service, typically via the application, SMS, or email, stating that a Driver has accepted your request. Until confirmation, Khatu Cab Service is not obligated to provide the requested service.
4.3. User Cancellation Policy
You may cancel a confirmed booking subject to the following conditions:
- Free Cancellation Window: You may cancel a ride without incurring any charges if the cancellation is made at least 15 minutes before the scheduled or estimated pickup time.
- Late Cancellation Fee: If you cancel a ride less than 15 minutes before the scheduled or estimated pickup time, a cancellation fee may be applied. The exact fee amount will be displayed in the application or on our website’s pricing section.
- No-Show Policy: If the Driver arrives at the pickup location and you are not present within 10 minutes of the scheduled or actual arrival time (whichever is later), the booking will be considered a “No-Show.” In such cases, you will be charged the full fare or a substantial no-show fee, as specified in our pricing policy.
4.4. Driver/Service Cancellation
Khatu Cab Service or the assigned Driver reserves the right to cancel a booking under certain circumstances, including but not limited to:
- Unsafe or inaccessible pickup/drop-off locations.
- Violation of these Terms by the User.
- Providing incorrect or incomplete booking information by the User.
- Unforeseen circumstances, such as vehicle breakdown, accident, extreme weather conditions, road closures, or other force majeure events.
- Security concerns or reasonable suspicion of fraudulent activity.
In most cases of Driver/Service cancellation, you will not be charged. However, if the cancellation is due to your breach of these Terms, applicable charges may still apply.
4.5. Rebooking
If a ride is cancelled, you will need to place a new booking request through the Service.
—5. User Conduct and Responsibilities
5.1. General Conduct
You agree to use the Service lawfully and in a manner that does not infringe the rights of, or restrict or inhibit the use and enjoyment of the Service by, any third party. This includes, but is not limited to, refraining from:
- Harassing, abusing, or intimidating Drivers or other users.
- Engaging in any fraudulent, illegal, or unauthorized activity.
- Causing damage to the Vehicle or any property of the Driver.
- Disrupting the normal operation of the Service.
- Using the Service for any commercial or unlawful purpose not expressly authorized by Khatu Cab Service.
5.2. Personal Safety and Belongings
You are responsible for your own safety and the safety of your accompanying passengers during a ride. Always ensure you wear seatbelts and, if applicable, provide and properly install appropriate child safety seats. Khatu Cab Service is not responsible for any personal belongings left in the Vehicle by Users. While Drivers may make reasonable efforts to return lost items, Khatu Cab Service is not liable for their recovery or any damages related to lost property.
5.3. Compliance with Laws
You must comply with all applicable laws and regulations while using the Service and during any transportation services provided by a Driver.
5.4. Communication
You agree to communicate with Drivers respectfully and professionally. Any abusive, offensive, or inappropriate communication is strictly prohibited.
—6. Driver Responsibilities (as relevant to Users)
While Drivers are independent contractors, Khatu Cab Service expects them to adhere to certain standards:
- Professional Conduct: Drivers are expected to maintain professional behavior and courtesy towards Users.
- Safe Operation: Drivers are expected to operate their Vehicles safely and in compliance with all traffic laws.
- Vehicle Condition: Drivers are expected to maintain their Vehicles in a clean, safe, and roadworthy condition.
- Route Adherence: Drivers are generally expected to follow the route suggested by the Service’s navigation system, unless otherwise directed by the User or necessary due to traffic or road conditions.
Any concerns regarding a Driver’s conduct or Vehicle condition should be reported to Khatu Cab Service customer support immediately.
—7. Pricing, Payments, and Billing
7.1. Fare Calculation
Fares for services will be calculated based on the distance, time, prevailing demand (surge pricing), applicable tolls, taxes, and any additional waiting charges or special requests. The estimated fare will be displayed in the app before you confirm your booking, but the final fare may vary based on the actual route taken, traffic conditions, and waiting time.
7.2. Payment Methods
Payment for services must be made through the methods accepted by Khatu Cab Service, which may include cash directly to the Driver, integrated in-app payment options (e.g., credit/debit cards, digital wallets), or other approved methods.
7.3. Surge Pricing
During periods of high demand, Khatu Cab Service may implement “surge pricing,” which will result in higher fares. You will be notified of any surge pricing before you confirm your booking.
7.4. Tolls and Taxes
Any applicable road tolls, parking fees, or government taxes related to your ride will be added to your final fare. You are responsible for these charges.
7.5. Waiting Charges
Waiting charges will commence if the Driver has waited at the pickup location for more than 5 minutes after the scheduled or actual arrival time, whichever is later. The rate for waiting charges will be specified in the app or on our website.
7.6. Refunds and Disputes
Refunds are granted at the sole discretion of Khatu Cab Service. If you believe there is an error in the billing or fare, you must contact Khatu Cab Service customer support within 48 hours of the ride completion with supporting details. We will investigate the matter and make a decision within a reasonable timeframe.
7.7. Promotions and Discounts
Khatu Cab Service may offer promotional codes, discounts, or special offers. These are subject to specific terms and conditions outlined with each promotion. They may not be transferable, may have expiration dates, and may not be combinable with other offers.
—8. Service Availability and System Maintenance
Khatu Cab Service strives for continuous availability of its Service. However, we do not guarantee uninterrupted access. The Service may be subject to limitations, delays, and other problems inherent in the use of the internet and electronic communications. We may also perform scheduled or unscheduled maintenance, which could temporarily affect the Service’s availability. We are not liable for any delays, failures, or damages resulting from such issues.
—9. Intellectual Property
All intellectual property rights related to the Khatu Cab Service website, mobile application, software, logos, trademarks, and all Content (excluding User-generated content, if any) are owned by Khatu Cab Service or its licensors. You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal, non-commercial use only. You may not copy, modify, distribute, sell, or lease any part of our Service or its Content, nor may you reverse engineer or attempt to extract the source code of the software.
—10. User-Generated Content and Feedback
If the Service allows you to submit comments, feedback, ratings, or other content (“User Content”), you grant Khatu Cab Service a worldwide, non-exclusive, royalty-free, perpetual, irrevocable, and sublicensable right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such User Content in any media. You represent and warrant that you own or have the necessary rights to grant us this license for any User Content you submit. You agree not to submit any User Content that is unlawful, defamatory, infringing, or otherwise objectionable.
10.1. Ratings and Reviews
Users may be able to rate and review Drivers. These ratings are crucial for maintaining the quality of our Service. You agree to provide fair, accurate, and non-defamatory ratings and reviews based on your actual experience. Khatu Cab Service reserves the right to remove any review that violates these Terms or is deemed inappropriate.

Your privacy is important to us. Our collection, use, and disclosure of personal information in connection with the Service are governed by our Privacy Policy. By using the Service, you consent to the data practices described in our Privacy Policy. Please ensure you read and understand our Privacy Policy.
—12. Disclaimers and Limitation of Liability
12.1. Disclaimer of Warranties
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE. KHATU CAB SERVICE DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT DEFECTS WILL BE CORRECTED.
12.2. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL KHATU CAB SERVICE, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, SUPPLIERS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING WITHOUT LIMITATION, DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, THAT RESULT FROM THE USE OF, OR INABILITY TO USE, THE SERVICE, OR FROM ANY TRANSPORTATION SERVICES PROVIDED BY DRIVERS. THIS LIMITATION APPLIES WHETHER THE ALLEGED LIABILITY IS BASED ON CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR ANY OTHER BASIS, EVEN IF KHATU CAB SERVICE HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGE.
IN NO EVENT SHALL THE TOTAL AGGREGATE LIABILITY OF KHATU CAB SERVICE FOR ALL CLAIMS RELATING TO THE SERVICE EXCEED THE GREATER OF ONE HUNDRED INDIAN RUPEES (INR 100) OR THE AMOUNT YOU PAID TO KHATU CAB SERVICE IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
12.3. Independent Contractors
You acknowledge that Drivers are independent contractors and not employees or agents of Khatu Cab Service. Khatu Cab Service is not liable for the actions, omissions, or negligence of any Driver.
—13. Indemnification
You agree to indemnify, defend, and hold harmless Khatu Cab Service and its affiliates, officers, directors, employees, agents, and licensors from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys’ fees) that such parties may incur as a result of or arising from your (or anyone using your account’s) violation of these Terms or your use of the Service, including but not limited to any claims arising from your conduct during a ride, damage to property, or violation of any law or the rights of a third party.
—14. Termination
We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, for any reason whatsoever, including, without limitation, if you breach these Terms. Upon termination, your right to use the Service will immediately cease.
If you wish to terminate your account, you may simply discontinue using the Service or contact us to request account deletion.
—15. Governing Law and Dispute Resolution
15.1. Governing Law
These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law principles. Specifically, these Terms will be governed by the laws applicable in the state of Rajasthan, India, and the city of Bikaner.
15.2. Arbitration (Optional, but Recommended for Robust T&C)
Any dispute, controversy, or claim arising out of or relating to these Terms, or the breach, termination, or invalidity thereof, shall be settled by arbitration in accordance with the provisions of the Arbitration and Conciliation Act, 1996 (as amended). The arbitration shall be conducted by a sole arbitrator appointed mutually by both parties. The seat and venue of the arbitration shall be Bikaner, Rajasthan, India. The language of the arbitration shall be English.
15.3. Jurisdiction
Subject to Section 15.2 (Arbitration), you agree that the courts in Bikaner, Rajasthan, India, shall have exclusive jurisdiction to hear and determine any actions or proceedings arising out of or in connection with these Terms or your use of the Service.
15.4. Class Action Waiver
You agree that any disputes or claims shall be brought on an individual basis only, and not in a class, consolidated, or representative action. By agreeing to these terms, you waive your right to participate in any class action litigation or class-wide arbitration against Khatu Cab Service.
—16. Miscellaneous
16.1. Severability
If any provision of these Terms is found to be unenforceable or invalid under any applicable law, such unenforceability or invalidity shall not render these Terms unenforceable or invalid as a whole, and such provisions shall be deleted without affecting the remaining provisions herein.
16.2. Entire Agreement
These Terms, together with the Privacy Policy and any other legal notices published by Khatu Cab Service on the Service, constitute the entire agreement between you and Khatu Cab Service concerning the Service and supersede all prior or contemporaneous agreements, understandings, discussions, or communications, whether written or oral.
16.3. Force Majeure
Khatu Cab Service shall not be liable for any failure to perform its obligations hereunder where such failure results from any cause beyond Khatu Cab Service’s reasonable control, including, without limitation, mechanical, electronic, or communications failure or degradation, acts of God, war, acts of terrorism, riots, governmental regulations, epidemics, pandemics, or natural disasters.
16.4. Assignment
You may not assign your rights or obligations under these Terms without our prior written consent. Khatu Cab Service may assign its rights and obligations under these Terms without restriction.
—17. Amendments to Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days’ notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the Service.
